Terms of service

These terms of service (“Terms”) govern your use of the opia app, the website opia.app and related services (together “opia”). By creating an account or using opia, you accept these Terms.
1. Provider
opia is operated by:

(“opia”, “we”, “us”). How we handle your data is described in our privacy policy.
2. Minimum age
You must be at least 16 years old to use opia. By using opia, you confirm that you meet this age and that your information is accurate.
3. Your account
- Your information must be true, and you keep it up to date.
- You protect access to your account and are responsible for all activity in it.
- If you suspect misuse of your account, let us know right away at hello@opia.app.
- An account is personal and not transferable.
- You can delete your account at any time in the app. What then happens to your data is described in the privacy policy.
4. Your content
Photos, videos, texts, events and other content you publish on opia remain yours. You grant us the non-exclusive, worldwide, royalty-free right to store, reproduce, technically adapt (e.g. compress) and display it in opia, to the extent needed to operate opia. This right ends when you delete the content or your account, except for content we must keep for legal reasons.
You are responsible for your content and make sure you have all necessary rights to it, including to images of other people, and that it doesn’t infringe the rights of others.
5. Rules of conduct
opia is about real encounters and mutual respect. In particular, you may not use opia to:
- break the law or infringe the rights of others;
- spread content that is unlawful, hateful, harassing, threatening, defamatory, pornographic or glorifies violence;
- impersonate someone else or create fake events;
- send spam or collect other people’s data without their consent;
- spread malware or gain unauthorised access to opia or our systems;
- disrupt opia, overload it or scrape it by automated means.
6. Reports and moderation
You can report content and block accounts. We review reports and may remove content or restrict accounts if we reasonably believe they violate these Terms or the law. We are not, however, obliged to review content in advance.
7. Events on opia
opia is a platform for discovering and sharing events. Events, their details and attendance come from users and organisers, not from us. We don’t organise or verify events and give no guarantee for their accuracy, taking place or safety. The respective organisers are responsible for their events; you attend at your own risk.
8. Costs
opia is currently free. If we introduce paid features in the future, such as tickets or subscriptions, additional terms will apply, which we’ll show you before any purchase. You won’t incur any costs without your explicit consent.
9. Intellectual property
opia itself, in particular its name, logo, software and design, belongs to us and is protected. Apart from your own content, these Terms don’t give you any rights to it. You may not copy, modify, distribute or create derivative works from opia without our written consent.
10. Availability and changes to opia
We continuously develop opia and may change, add or discontinue features. We strive for smooth operation but cannot guarantee that opia is always available and error-free.
11. Suspension and termination
You can stop using opia and delete your account at any time. We may suspend or delete your account if you violate these Terms, if the law requires it or if it’s necessary to protect opia or others. Provisions that by their nature should survive, such as those on rights and liability, remain in force.
12. Liability
opia is provided as is. To the extent permitted by law, we exclude all liability, in particular for other people’s content, for events and for indirect or consequential damages, lost profits and loss of data. This doesn’t exclude liability for intent and gross negligence or any liability that cannot be limited under mandatory law.
13. Changes to these Terms
We may change these Terms. We’ll inform you about material changes in advance in an appropriate way, for example in the app. If you keep using opia afterwards, the new Terms apply. If you don’t agree, you can delete your account.
14. Language
These Terms are available in German, French, Italian and English. In case of discrepancies, the German version prevails.
15. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules. The place of jurisdiction is Winterthur, Canton of Zurich, Switzerland. Mandatory places of jurisdiction, in particular for consumers, are reserved.
